歡迎您使用「智透析 IQThrill」(以下稱「本應用程式」)。本應用程式由博醫科技有限公司(以下稱「本公司」)開發、維護及提供。本服務條款(以下稱「本條款」)係您與本公司之間具有法律效力之契約,規範您使用本應用程式之權利義務。請於使用前完整閱讀。

第一章 條款適用範圍與接受

1.1 您下載、安裝、註冊、登入或實際使用本應用程式,即視為已完整閱讀、理解並同意本條款及本公司另行公告之《隱私權條款》之全部內容。

1.2 若您不同意本條款之全部或部分內容,請立即停止使用本應用程式並刪除相關資料。

1.3 本條款為定型化契約,本公司就條款內容已盡合理告知義務。您於註冊時須勾選「我已閱讀並同意本服務條款與隱私權條款」之選項,完成電子文件形式之同意(依《電子簽章法》第 4 條規定)。

1.4 若您代理他人(如家屬代為操作)使用本應用程式,您聲明已取得該他人之合法授權,並由您與該他人共同對本條款負責。

第二章 服務內容

2.1 本應用程式為病患端個人健康紀錄工具,提供下列功能:

(一) 透析通路檔案管理

由您建立及維護自身之通路類型、建立日期、通路設計圖、維護紀錄、醫囑紀錄、麻醉藥使用紀錄等資訊,供您平時自我追蹤,並可於就醫時直接出示給醫師參考。

(二) 透析紀錄追蹤

由您於每次透析後輸入並儲存日期、血流速、靜脈壓、透析前後血壓、體重、血紅素、血比容等資料。

(三) 趨勢視覺化

將前述紀錄以圖表方式呈現,供您個人參考。

(四) 通路狀態提示

當您輸入之數值較您個人初始值有顯著變化時,於主畫面以「正常 / 注意」狀態提示您。

(五) 醫師聯絡資訊管理

由您主動將自身主治醫師之聯絡資訊(電話號碼、通訊軟體 ID 等)儲存於本應用程式內,並提供一鍵撥號或開啟通訊軟體之捷徑。本功能僅為您手機通訊錄之延伸,非本應用程式提供之醫病通訊服務。

(六) 雲端備份與跨裝置同步

將您之紀錄資料以加密方式儲存於雲端,供您同一帳號之多裝置同步存取。

2.2 本應用程式之功能、介面及內容,本公司得於不違反本條款重大目的之範圍內,隨時新增、修改、調整或下架,無須事先個別通知。

2.3 本應用程式提供之服務分為「免費試用版」與「付費訂閱版」,兩者之功能差異依本應用程式內購買頁面與本條款第五章為準。

2.4 本應用程式為純病患端工具。本公司或本公司之合作醫師均不會於本應用程式中存取、修改或回應您之資料。如您之主治醫師需查閱您之紀錄,應由您於就醫時主動展示。

第三章 帳號註冊與管理

3.1 您須年滿 18 歲方得以本人名義註冊帳號。未滿 18 歲者,須由其法定代理人(父母或監護人)代為註冊及操作,並由法定代理人對本條款負責。

3.2 您應提供真實、正確、完整之註冊資訊,並於資訊變更時及時更新。若因您提供錯誤或過時之資訊致生損害,本公司不負相關責任。

3.3 您應妥善保管帳號與密碼,不得提供、出借、轉讓或允許他人使用。您應對該帳號下發生之所有活動負責。

3.4 若發現帳號遭未經授權之使用,您應立即通知本公司,並依本公司指示採取必要措施。

3.5 一個身分原則上限註冊一個帳號。本公司發現重複註冊或盜用他人身分註冊者,得逕行停用相關帳號。

第四章 使用者義務與禁止行為

4.1 您使用本應用程式時,應遵守中華民國法令、一般公序良俗及本條款。

4.2 您不得從事下列行為:

  • (一) 於本應用程式輸入虛假之醫療資料、或意圖混淆系統呈現結果之資料
  • (二) 以任何方式破解、反向工程、修改本應用程式之原始碼或資料庫
  • (三) 利用任何自動化程式、機器人、爬蟲存取本應用程式
  • (四) 干擾或破壞本應用程式之正常運作
  • (五) 以本應用程式從事任何違法、侵害他人權利或妨害公共秩序之行為
  • (六) 將本應用程式之資料未經本公司同意對外散布、轉售或商業利用
  • (七) 冒用他人身分註冊或使用本應用程式
  • (八) 其他經本公司認定為不當之使用方式

4.3 您違反前項義務致本公司或第三人受有損害者,應負損害賠償責任,本公司並得逕行停用您之帳號或終止本條款。

第五章 訂閱、付款與取消

5.1 訂閱方案

  • 月費訂閱:NT$199 / 月(或當地對應幣別)
  • 年費訂閱:NT$1,999 / 年(或當地對應幣別)

實際價格依本應用程式內購買頁面顯示為準,本公司保留調整訂閱費用之權利,調整將於生效前公告。

5.2 付款

訂閱費用透過 Apple App Store(iOS 用戶)或 Google Play Store(Android 用戶)之內購機制收取,本公司不直接處理您之信用卡或付款資訊。

5.3 自動續訂

  • (一) 訂閱於到期前 24 小時自動續訂,除非您於該時點前關閉自動續訂
  • (二) 續訂費用將於到期前 24 小時內自您之 Apple ID / Google 帳戶扣款
  • (三) 續訂價格為訂閱當下之公告價格

5.4 取消訂閱

  • (一) iOS 用戶:於「設定 > Apple ID > 訂閱」中取消
  • (二) Android 用戶:於「Google Play 商店 > 個人資料 > 付款與訂閱 > 訂閱項目」中選擇本應用程式取消
  • (三) 取消後,您仍可使用訂閱服務至當期結束日,結束後自動降為免費試用版

5.5 退款

退款請求應依 Apple App Store 或 Google Play Store 之退款政策直接向該平台提出。本公司原則上不直接處理退款。

5.6 試用筆數限制

免費試用版可建立至多 3 筆透析紀錄。超過上限後須升級為訂閱版方可繼續新增紀錄,但既有紀錄之查看不受限制。

第六章 醫療免責聲明

重要提醒:本應用程式為個人健康紀錄工具,不能取代專業醫療診斷或治療

6.1 服務性質

本應用程式之功能僅限於提供血液透析相關生理數據之紀錄、呈現、儲存,以及儲存您主動建立之醫師聯絡資訊。本應用程式為個人健康紀錄工具,並非醫療器材,亦非醫療服務之提供者,亦非醫病通訊平台。

6.2 資訊性質

您於本應用程式中所查看之任何數值、圖表、提示、狀態指示或其他形式之資訊,均屬一般性參考資料,不構成下列任一事項:

  • 醫療診斷
  • 治療建議或處方
  • 醫師之專業判斷
  • 預後推測
  • 緊急醫療服務
  • 取代醫師臨床評估之依據

本應用程式不具備取代醫師臨床評估或醫療專業行為之功能。

6.3 醫療決策之唯一依據

您之健康狀況評估、疾病診斷、通路功能判定、治療方式選擇及其他一切醫療行為,悉以具醫療資格之臨床醫師之專業判斷及正式醫囑為唯一依據。本應用程式提供之任何資訊,不得被視為或解讀為醫囑、診斷或治療建議。

6.4 緊急情況之處理

若您出現任何身體不適、透析通路功能異常、或其他可能危及健康之情形,應立即聯絡您之主治醫師或醫療團隊,並於必要時立即前往醫療院所接受評估,或撥打 119 求助。

任何情況下,您均不應因等待本應用程式之回應、提示或同步,而延遲就醫或延遲執行醫師之醫囑。

6.5 不適用對象與情境

本應用程式不適用於下列情境,您不應於以下情境依賴本應用程式:

  • (一) 緊急醫療事件之判斷或處置
  • (二) 取代洗腎中心或醫療機構之既有醫療流程
  • (三) 取代醫師、護理師或個案管理師之專業職能
  • (四) 用於醫師對病患之正式醫療診斷或治療決策依據
  • (五) 13 歲以下兒童透析病患(除非由具備醫學知識之法定代理人協助操作,並理解本條款全部內容)

6.6 「醫師聯絡資訊」功能之性質

本應用程式所提供之「醫師聯絡資訊」儲存功能,僅為您手機通訊錄之延伸,提供您快速撥打電話或開啟通訊軟體之捷徑。本功能具有下列特性,請您務必理解:

  • (一) 本應用程式不負責傳遞您與醫師間之訊息
  • (二) 您撥打之電話或發送之訊息,均係透過您裝置之原生功能進行,本應用程式僅提供啟動捷徑
  • (三) 您所儲存之醫師聯絡資訊是否正確、可達、即時回應,均非本應用程式可保證之事項
  • (四) 醫師未必能即時回應您之來電或訊息;緊急情況請直接撥打 119 或前往急診
  • (五) 本應用程式不是醫病諮詢服務、不是醫療熱線、不是緊急救助管道

第七章 一般免責與責任限制

7.1 服務「現狀」提供

本應用程式以「現狀」(as is)及「現有功能」(as available)方式提供。本公司不保證本應用程式之運作將完全無中斷、無錯誤、無延遲或無遺漏。

7.2 責任限制

於中華民國法律允許之最大範圍內,本公司就下列事項不負法律責任:

  • (一) 因網路傳輸延遲、中斷或錯誤致資料未即時同步
  • (二) 因您之裝置故障、作業系統不相容、儲存空間不足致功能受限
  • (三) 因第三方服務(雲端供應商、電信業者、推播服務等)中斷致功能暫時不可用
  • (四) 因您誤解、誤用本應用程式所呈現之資訊所生之後果
  • (五) 因您未即時就醫、未遵從醫囑或自行依本應用程式資料調整治療所生之健康後果
  • (六) 因不可抗力(天災、戰爭、政府命令、法令變更等)致服務中斷

7.3 損害賠償上限

於中華民國法律允許之最大範圍內,本公司就因本應用程式所生之一切損害,對單一使用者之賠償總額,以該使用者於前 12 個月實際支付予本公司之訂閱費用為上限。

7.4 法律強制規定優先

本章之免責及責任限制,於違反消費者保護法或其他法律強制規定者,於該等規定之範圍內不適用。

第八章 智慧財產權

8.1 本應用程式之所有著作權、商標、專利(包含但不限於中華民國發明專利申請案號 114135952「血液透析通路資訊整合系統」)、營業秘密及其他智慧財產權,均屬本公司或其授權人所有。

8.2 您僅取得本應用程式於個人非商業用途範圍內之有限、非專屬、不可轉讓、可撤回之使用授權。本條款未明示授予之權利,均保留予本公司。

8.3 您不得對本應用程式進行重製、改作、編輯、散布、公開傳輸、出租、販售、反向工程或其他侵害本公司智慧財產權之行為。

8.4 您於本應用程式中輸入之個人資料(透析紀錄、影像等)所有權歸屬於您。本公司僅於本條款第二章及《隱私權條款》所定範圍內處理該等資料。

第九章 服務中止、終止與帳號停用

9.1 您得隨時於本應用程式內刪除帳號或停止使用本應用程式。

9.2 本公司於下列情形,得不經通知逕行停用您之帳號或終止本條款:

  • (一) 您違反本條款或《隱私權條款》之重大義務
  • (二) 您提供虛假身分或盜用他人身分
  • (三) 您之使用行為對本應用程式或其他使用者造成損害或威脅
  • (四) 法令要求或主管機關命令

9.3 帳號停用或終止後,您之資料處理依《隱私權條款》第九章規定辦理。

9.4 本公司得隨時調整、暫停或終止本應用程式之全部或部分服務。涉及重大變更者,本公司將於合理期間前以應用程式內公告或推播方式通知。

9.5 服務終止前已支付之訂閱費用,本公司將依比例退還未使用之部分,或提供等值之替代方案,供您選擇。

第十章 第三方服務

10.1 本應用程式整合下列第三方服務:Apple App Store、Google Play Store、雲端儲存供應商、推播通知服務等。各第三方服務之使用,另適用各該服務提供者之服務條款與隱私政策。

10.2 因第三方服務之變更、中止或終止致本應用程式部分功能不可用者,本公司將盡合理努力提供替代方案,但不負損害賠償責任。

第十一章 條款修改

11.1 本公司得視營運需要、法令變更或服務調整,隨時修訂本條款。

11.2 修訂後之內容將於本應用程式內公告。涉及您權利義務之重大變更,本公司將於變更生效前以推播或電子郵件方式通知,並要求您於本應用程式內重新勾選同意。

11.3 您於變更生效後仍繼續使用本應用程式者,即視為同意修訂內容。若您不同意修訂內容,應停止使用並得申請刪除帳號。

第十二章 聯絡方式

如您對本條款或本應用程式相關事宜有疑義,請透過以下方式聯絡本公司:

本公司將於收到您之來信後 15 個工作日內回覆。

第十三章 準據法與管轄

13.1 本條款之解釋及適用,以中華民國法律為準據法。

13.2 您與本公司因本應用程式所生之爭議,雙方應本誠信原則協商解決。協商不成者,以本公司登記所在地之地方法院(目前為[請填入])為第一審管轄法院,但消費者保護法或其他法律強制規定者,從其規定。

【BroadMed Technology Co., Ltd. — IQThrill Terms of Service】

Welcome to IQThrill (the "Application"), developed and operated by BroadMed Technology Co., Ltd. (the "Company"). These Terms of Service (the "Terms") constitute a legally binding agreement between you and the Company governing your use of the Application. Please read carefully before use.

CHAPTER 1 — APPLICATION AND ACCEPTANCE

1.1 By downloading, installing, registering, logging in to, or otherwise using the Application, you are deemed to have fully read, understood, and agreed to these Terms and the Company's Privacy Policy.

1.2 If you do not agree to all or part of these Terms, please immediately stop using the Application and delete related data.

1.3 These Terms constitute a standard form contract. Upon registration, you must check the option "I have read and agreed to the Terms of Service and Privacy Policy" to complete electronic acknowledgment, which constitutes valid written consent under Article 4 of Taiwan's Electronic Signatures Act.

1.4 If you use the Application on behalf of another person (such as a family member acting as caregiver), you represent that you have obtained that person's lawful authorization, and both of you shall be jointly responsible under these Terms.

CHAPTER 2 — SCOPE OF SERVICE

2.1 The Application is a personal health record tool for patients, providing the following functions:

(1) Vascular access profile management

You may create and maintain your access type, creation date, anatomy diagram, maintenance records, physician notes, and anesthesia records, for your personal tracking and to display to physicians during medical visits.

(2) Dialysis session record tracking

You may input and store date, blood flow rate, venous pressure, pre/post-dialysis blood pressure, body weight, hemoglobin, and hematocrit after each session.

(3) Trend visualization

Aforementioned records are presented in chart form for your personal reference.

(4) Access status indicator

When your input values significantly differ from your personal baseline, the home screen displays a "Normal" or "Attention" status indicator.

(5) Physician contact information storage

You may save your physician's contact information (phone number, messaging app ID, etc.) within the Application, with one-tap shortcuts to dial or open messaging apps. This function is merely an extension of your phone's contacts; the Application does not provide a patient-physician communication service.

(6) Cloud backup and cross-device sync

Your records are encrypted and stored in the cloud for synchronized access across multiple devices under the same account.

2.2 The Company may, without prior individual notice, add, modify, adjust, or remove functions, interfaces, and content of the Application within the scope that does not violate the material purposes of these Terms.

2.3 The Application is offered as a "free trial version" and a "paid subscription version." Functional differences shall be governed by the in-app purchase page and Chapter 5 of these Terms.

2.4 The Application is a patient-side tool only. Neither the Company nor any cooperating physicians access, modify, or respond to your data within the Application. If your physician needs to view your records, you should actively present them during medical visits.

CHAPTER 3 — ACCOUNT REGISTRATION AND MANAGEMENT

3.1 You must be at least 18 years old to register an account in your own name. Minors under 18 must have their legal representative register and operate the Application on their behalf, with the legal representative being responsible under these Terms.

3.2 You shall provide true, accurate, and complete registration information and update it promptly upon changes.

3.3 You shall safeguard your account and password, and may not provide, lend, transfer, or allow others to use them.

3.4 If unauthorized use of your account is discovered, you shall immediately notify the Company and take necessary measures.

3.5 In principle, one identity is limited to one account. The Company may suspend duplicate or fraudulently registered accounts.

CHAPTER 4 — USER OBLIGATIONS AND PROHIBITED CONDUCT

4.1 You shall comply with the laws of the Republic of China (Taiwan), public order and good morals, and these Terms.

4.2 You shall not engage in any of the following:

  • (1) Inputting false medical data or data intended to confuse the system's outputs
  • (2) Decompiling, reverse-engineering, or modifying the Application's source code or database
  • (3) Using automated scripts, bots, or crawlers to access the Application
  • (4) Interfering with or disrupting the normal operation of the Application
  • (5) Using the Application for any illegal activity, infringement of others' rights, or disturbance of public order
  • (6) Distributing, reselling, or commercially exploiting the Application's data without the Company's consent
  • (7) Impersonating others to register or use the Application
  • (8) Other improper uses as determined by the Company

4.3 If you violate the foregoing obligations and cause damage to the Company or third parties, you shall be liable for damages, and the Company may suspend your account or terminate these Terms.

CHAPTER 5 — SUBSCRIPTION, PAYMENT, AND CANCELLATION

5.1 Subscription Plans

  • Monthly: NT$199 / month (or local equivalent)
  • Annual: NT$1,999 / year (or local equivalent)

Actual prices are as displayed on the in-app purchase page.

5.2 Payment

Subscription fees are collected through Apple App Store (iOS) or Google Play Store (Android) in-app purchase mechanisms. The Company does not directly handle your credit card or payment information.

5.3 Auto-Renewal

  • (1) Subscription auto-renews 24 hours before expiration unless you turn off auto-renewal before that time
  • (2) Renewal fees will be charged from your Apple ID / Google account within 24 hours before expiration
  • (3) Renewal price is the price announced at the time of renewal

5.4 Cancellation

  • (1) iOS: Settings > Apple ID > Subscriptions > IQThrill > Cancel
  • (2) Android: Google Play Store > Profile icon > Payments & subscriptions > Subscriptions > IQThrill > Cancel
  • (3) After cancellation, you may continue to use the subscription services until the end of the current period

5.5 Refunds

Refund requests should be submitted directly to Apple App Store or Google Play Store according to their respective refund policies.

5.6 Free Trial Limit

The free trial version allows up to 3 dialysis records. After this limit, you must upgrade to the subscription version to add new records, but viewing of existing records is not restricted.

CHAPTER 6 — MEDICAL DISCLAIMER

Important: The Application is a personal health record tool and cannot replace professional medical diagnosis or treatment.

6.1 Nature of the Service

The Application's functions are limited to recording, displaying, and storing physiological data related to hemodialysis, and storing physician contact information you actively enter. The Application is a personal health record tool. It is not a medical device, not a provider of medical services, and not a patient-physician communication platform.

6.2 Nature of Information

Any values, charts, notifications, status indicators, or other forms of information displayed within the Application are general reference information only and do not constitute any of the following:

  • Medical diagnosis
  • Treatment recommendations or prescriptions
  • Professional medical judgment
  • Prognosis prediction
  • Emergency medical services
  • A substitute for clinical evaluation by a physician

The Application is not intended to replace clinical evaluation or professional medical services provided by qualified physicians.

6.3 Sole Basis for Medical Decisions

All assessments of your health condition, disease diagnosis, determination of vascular access function, selection of treatment methods, and any other medical decisions shall be based solely on the professional judgment and formal medical orders of licensed clinical physicians. Any information provided by the Application shall not be construed or interpreted as medical advice, diagnosis, or treatment recommendations.

6.4 Emergency Situations

If you experience any physical discomfort, vascular access dysfunction, or other conditions that may endanger your health, you shall immediately contact your attending physician or medical care team and, when necessary, promptly seek evaluation at a medical institution or call emergency services (119 in Taiwan).

Under no circumstances shall you delay seeking medical care or delay following physician's orders while waiting for the Application's response, notification, or synchronization.

6.5 Not Suitable For

The Application is not suitable for, and you shall not rely on the Application in, the following situations:

  • (1) Judgment or handling of emergency medical events
  • (2) Replacing existing medical workflows of dialysis centers or healthcare institutions
  • (3) Replacing the professional functions of physicians, nurses, or case managers
  • (4) Serving as the basis for a physician's formal diagnosis or treatment decisions
  • (5) Pediatric dialysis patients under 13 years of age (unless operated by a legal representative with medical knowledge who fully understands these Terms)

6.6 Nature of the "Physician Contact" Function

The "Physician Contact Information" storage function provided in the Application is merely an extension of your phone's contacts, providing shortcuts to dial calls or open messaging apps. Please understand the following:

  • (1) The Application does not transmit messages between you and your physician
  • (2) Calls or messages you initiate are conducted through your device's native functions; the Application only provides launch shortcuts
  • (3) The Application cannot guarantee the accuracy, reachability, or timely response of physician contact information you store
  • (4) Physicians may not respond to your calls or messages in real time; in emergencies, call 119 or go to the emergency room directly
  • (5) The Application is not a medical consultation service, not a medical hotline, and not an emergency assistance channel

CHAPTER 7 — GENERAL DISCLAIMERS AND LIMITATION OF LIABILITY

7.1 "As Is" Service

The Application is provided on an "as is" and "as available" basis. The Company does not warrant that the Application will operate without interruption, error, delay, or omission.

7.2 Limitation of Liability

To the maximum extent permitted by the laws of the Republic of China (Taiwan), the Company shall not be liable for the following:

  • (1) Data not synchronized in real time due to network transmission delays, interruptions, or errors
  • (2) Function limitations due to your device malfunction, OS incompatibility, or insufficient storage
  • (3) Temporary unavailability due to interruptions of third-party services (cloud providers, telecommunications carriers, push notification services, etc.)
  • (4) Consequences arising from your misunderstanding or misuse of information presented by the Application
  • (5) Health consequences arising from your failure to seek timely medical care, failure to follow medical orders, or self-adjustment of treatment based on the Application's data
  • (6) Service interruptions due to force majeure (natural disasters, war, government orders, legal changes, etc.)

7.3 Damages Cap

To the maximum extent permitted by the laws of the Republic of China (Taiwan), the Company's total liability for any damages arising from the Application, with respect to a single user, shall be capped at the actual subscription fees paid by that user to the Company in the preceding 12 months.

7.4 Mandatory Legal Provisions Prevail

The disclaimers and limitations of liability in this chapter shall not apply to the extent they violate Taiwan's Consumer Protection Act or other mandatory legal provisions.

CHAPTER 8 — INTELLECTUAL PROPERTY

8.1 All copyrights, trademarks, patents (including but not limited to Taiwan Invention Patent Application No. 114135952, "Hemodialysis Access Information Integration System"), trade secrets, and other intellectual property rights of the Application belong to the Company or its licensors.

8.2 You are granted only a limited, non-exclusive, non-transferable, revocable license to use the Application for personal non-commercial purposes. All rights not expressly granted herein are reserved by the Company.

8.3 You shall not reproduce, modify, edit, distribute, publicly transmit, rent, sell, reverse-engineer, or otherwise infringe the Company's intellectual property rights.

8.4 Personal data (dialysis records, images, etc.) entered by you in the Application belongs to you. The Company processes such data only within the scope defined in Chapter 2 of these Terms and the Privacy Policy.

CHAPTER 9 — SUSPENSION, TERMINATION, AND ACCOUNT DEACTIVATION

9.1 You may delete your account or stop using the Application at any time within the Application.

9.2 The Company may suspend your account or terminate these Terms without notice in the following circumstances:

  • (1) You materially violate these Terms or the Privacy Policy
  • (2) You provide false identity or impersonate others
  • (3) Your use causes damage or threat to the Application or other users
  • (4) Required by law or competent authority

9.3 After account suspension or termination, your data will be processed according to Chapter 9 of the Privacy Policy.

9.4 The Company may at any time adjust, suspend, or terminate all or part of the Application's services. For material changes, the Company will notify you within a reasonable period via in-app announcement or push notification.

9.5 For subscription fees paid before service termination, the Company will refund the unused portion proportionally, or provide an equivalent alternative for your selection.

CHAPTER 10 — THIRD-PARTY SERVICES

10.1 The Application integrates with third-party services such as Apple App Store, Google Play Store, cloud storage providers, and push notification services. Use of such services is additionally subject to their respective terms of service and privacy policies.

10.2 If part of the Application becomes unavailable due to changes, suspensions, or terminations of third-party services, the Company will make reasonable efforts to provide alternatives but shall not be liable for damages.

CHAPTER 11 — AMENDMENTS TO THESE TERMS

11.1 The Company may amend these Terms at any time due to operational needs, legal changes, or service adjustments.
